Scope: These conditions govern access and use of our site and purchases made through it. The site mainly serves professional buyers (B2B), but also offers B2C sales (individual consumers).
1. Acceptance and updates
By using the site or placing an order you accept these Terms and the associated policies (Privacy, Cookies, Shipping and Returns/Quality).
We may modify them by publishing a new version with update date; subsequent use implies acceptance. Changes will not affect already confirmed orders except where required by law.
2. Account and accuracy of data
You must keep your data up to date and protect your credentials.
If you act on behalf of a company, you declare that you have the authority to represent it.
3. Ordering process and formation of contract
3.1. Your order is a purchase offer. The contract is concluded when we confirm in writing or dispatch the products (whichever occurs first).
3.2. We may reject or cancel orders for manifest error in price/availability, suspicion of fraud or breach of conditions.
3.3. Samples/prototypes: non-refundable except in case of manufacturing defect.
4. Prices, taxes and invoicing
4.1. B2B: unless expressly stated, prices are understood net of taxes; taxes, duties and tariffs are borne by the buyer according to its jurisdiction.
4.2. B2C (EU and others): we display prices including taxes where applicable; import duties and taxes outside your country/region may be your responsibility.
4.3. Invoices: issued with the data you provide; you are responsible for their accuracy.
5. Shipping, delivery and transfer of risk
5.1. International B2B: unless otherwise agreed in writing, delivery is made according to Incoterms® 2020 – EXW (Ex Works) Alicante, Spain. The buyer assumes the organization and cost of transport, insurance, import clearance and any applicable duties or taxes.
5.2. B2B: risk transfers to the buyer at the moment the goods are placed at its disposal at our facilities in Alicante (Spain). Ownership transfers after full payment.
5.3. B2C: risk transfers upon physical delivery to the consumer. Indicated delivery times are indicative.
6. Handcrafted products, customization and tolerances
6.1. In customized products (materials, colors, branding) reasonable tolerances of color/finish inherent to the artisanal process may exist.
6.2. If you provide brands/logos/designs, you guarantee that you own the necessary rights and will hold us harmless against third-party claims.
7. Returns and non-conformities
7.A — B2B
Standard Atelier COSTÀ products:
In case of defect in a pair, we will proceed with replacement or, if not possible, with a proportional refund.Customized B2B productions:
After validation and final approval of the prototype or technical sheet (“OK to produce”), no returns or modifications are accepted.
Sole exception: manifest defect that renders the product unusable (e.g., material breakage, open seam). In that case, Atelier COSTÀ may offer repair, limited replacement or refund, at its choice.
No returns are accepted for change of mind nor for minor variations inherent to the artisanal process (tolerances of color, texture or measurements ±5%).
7.B — B2C (Consumers)
Right of withdrawal: you may withdraw within 14 calendar days from receipt, except for legal exceptions (personalized/made-to-order products, or sealed items opened when required by law).
Procedure: write to us at info@ateliercosta.com indicating order number. Products must be returned in perfect condition, preferably with original packaging.
Return cost: unless defect or our error, borne by you.
Refund: within a maximum of 14 days from receipt or proof of shipment; we may withhold it until we effectively receive the products.
Defects/warranty: see clause 8.
(If your country grants a longer period or more favorable consumer conditions, those mandatory rules will prevail.)
8. Warranty
B2B: commercial warranty limited to manufacturing defects, valid for 6 months from delivery.
Exclusions: normal wear, misuse, improper storage, humidity, chemicals, handling by third parties or lack of care according to instructions.B2C (EU consumers): products have the legal conformity warranty provided by the consumer’s country legislation (minimum 2 years in the EU).
⚠️ This warranty covers only manufacturing or conformity defects present at delivery.
It does not cover normal wear from use, misuse or incorrect maintenance.
9. Payments and security
Payments are processed through external gateways (Stripe, PayPal, etc.).
We do not store full card data. Transactions may be subject to anti-fraud controls.
10. Intellectual property
The content of the site (texts, images, designs) is our property or used under license.
Reproduction is not permitted without express authorization.
We may display images of completed projects in our portfolio; if you do not wish this, notify us in writing.
11. Prohibited uses
It is prohibited to:
infringe laws,
violate third-party rights,
introduce malicious software,
carry out massive scraping,
bypass security measures or interfere with the site/operations.
12. Limitation of liability
We are not liable for indirect or consequential damages (lost profits, business loss, data loss, etc.).
Our total liability is limited to the amount actually paid for the products/services in question, except where the law provides otherwise (especially regarding consumers).
13. Force majeure
We will not be liable for non-performance due to causes beyond our reasonable control (force majeure), including catastrophes, government actions, labor disputes, supply failures, pandemics or logistical/customs blockages.
14. Applicable law and jurisdiction
B2B: these Terms are governed by the laws of the State of Delaware (USA). Any dispute will be submitted to the competent courts of Newark, Delaware (USA).
B2C (consumers): these Terms are governed by the law of Delaware (USA). However, this law does not limit the mandatory rights granted to you by the regulations of your country of residence (for example, the legal warranty in the European Union).
15. Languages
These Terms may be published in several languages. In case of discrepancy, the Spanish version prevails.
